These Terms of Service govern your access to and use of FirehouseCoffee.com and purchases from Firehouse Coffee, LLC. “Firehouse Coffee,” “we,” “us,” and “our” mean Firehouse Coffee, LLC.

“Website” and “Service” mean this website and the products, features, content, and services offered through it.

By visiting the Website, creating an account, sending information, or placing an order, you agree to these Terms. You also agree to the policies referenced here. If you do not agree, you may not use the Website or Service.

Shopify hosts our online store and provides the platform we use to offer our products and services.

Eligibility and Acceptable Use

To order or create an account, you must be at least the age of majority in your state of residence. You must also be legally able to enter a binding agreement.

You may not use the Website, Service, or our products for an unlawful, fraudulent, abusive, or unauthorized purpose. You must follow all applicable federal, state, and local laws when using the Website.

Customer Accounts

Keep your account credentials private. You are responsible for protecting them and for activity through your account. Give Firehouse Coffee accurate, complete, and current information.

Tell us promptly if you believe someone has accessed or used your account or payment information without permission.

We may suspend or close accounts that contain false information, appear fraudulent, or violate these Terms. We may also act if an account threatens the security of the Website or our customers.

Product Information

We make reasonable efforts to describe and show products accurately. Photos, colors, packaging, labels, artwork, ingredients, availability, roast appearance, and other details may sometimes differ from what is shown.

Coffee is an agricultural product. Beans, roast traits, aroma, flavor, grind, and appearance can vary naturally between batches. These changes do not necessarily mean that a product is defective.

We may correct or update descriptions and photos without notice. We may also change, replace, limit, or stop offering a product at any time.

Medical and Emergency-Service Terminology

Firehouse Coffee uses firefighter, emergency-service, medical, hospital, and related terms in its branding and product stories.

These names, descriptions, characters, and designs are not medical advice, medical claims, diagnoses, treatments, or promises of health benefits.

Unless expressly stated, these terms do not imply sponsorship, endorsement, certification, or affiliation. This applies to hospitals, fire departments, police departments, emergency-service agencies, professional groups, and government entities.

Coffee and some other products contain caffeine. Each person's sensitivity to caffeine differs.

If you have a medical condition, allergy, dietary restriction, or question about caffeine, consult an appropriate healthcare professional. Contact Firehouse Coffee before buying if you need more product information.

Orders and Order Acceptance

When you place an order, you make an offer to buy. An order confirmation does not guarantee that we have accepted the order or will fulfill it.

To the extent permitted by law, we may refuse, limit, hold, or cancel an order for reasons including:

• A product is unavailable.
• There is a pricing, description, inventory, or technical error.
• We suspect fraud or unauthorized payment activity.
• The order appears intended for unauthorized resale.
• The quantity is unusually large.
• Shipping restrictions apply.
• The order violates these Terms or another Firehouse Coffee policy.

If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

You are responsible for checking the products, grinds, quantities, billing details, and shipping details before you order.

Prices, Payments, and Taxes

Prices, promotions, discounts, and product availability may change without notice. In general, the price charged is the one shown at checkout when you order. Obvious errors may be corrected.

Applicable taxes and shipping charges are calculated or shown at checkout. You represent that you are authorized to use the payment method you provide.

We may correct pricing, promotional, inventory, or typing errors and cancel affected orders. Discounts cannot be combined unless expressly allowed.

Promotional codes have no cash value. They may be limited, changed, or ended as permitted by law.

Shipping and Delivery

Our Shipping Policy governs processing and shipping and forms part of these Terms.

You must provide a complete, correct delivery address. Shipping dates and carrier delivery dates are estimates unless expressly stated to be guaranteed.

Firehouse Coffee is not responsible for delays caused by USPS, severe weather, transport disruptions, or incorrect information you provide. This also applies to natural disasters, government actions, or other events beyond our reasonable control.

Our Shipping Policy and Refund Policy govern claims for delayed, missing, damaged, misdelivered, refused, unclaimed, or returned packages. Applicable law also applies.

Returns, Replacements, and Refunds

Our Refund Policy governs returns, replacements, exchanges, and refunds. It forms part of these Terms.

Some goods cannot be returned simply because of personal taste or preference. Coffee, food, custom products, and other goods may be perishable, consumable, personalized, or unfit for resale.

Nothing in these Terms or our Refund Policy limits any non-waivable rights available under applicable law.

Subscriptions and Recurring Orders

When you buy a subscription, you authorize recurring charges to its payment method. The charges follow the price, frequency, and terms shown when you sign up.

A subscription continues until canceled or otherwise ended. You must manage your products, delivery schedule, payment details, and shipping address before the next order is processed.

A change or cancellation made after processing starts may not apply to that order. Orders already prepared, fulfilled, or given to USPS cannot necessarily be canceled.

Subscription prices, discounts, products, and availability may change for future orders. We will give any notice required by law and the terms presented when you enrolled.

Additional terms shown at enrollment or in your subscription account form part of these Terms.

Gift Cards and Promotions

Gift cards, promotional credits, discount codes, giveaways, and special offers may have extra conditions disclosed when issued.

Gift cards and promotional offers may not be copied, resold, transferred for value, or used fraudulently.

We may reject or cancel gift cards, discounts, credits, or promotional transactions obtained or used through fraud, mistake, abuse, or unauthorized activity.

Intellectual Property

The Website and its content are owned by or licensed to Firehouse Coffee and protected by intellectual-property laws. Content includes text, product descriptions, photos, illustrations, artwork, graphics, logos, packaging, labels, characters, videos, website design, product names, slogans, and other original material.

FIREHOUSE COFFEE®, the Firehouse Coffee name and logo, and Firehouse Coffee's product names, designs, characters, slogans, packaging, trade dress, and other brand identifiers are trademarks, registered trademarks, or other protected intellectual property.

Nothing on the Website grants a license or right to use Firehouse Coffee's intellectual property.

Without prior written authorization, no protected content or brand identifier may be copied, reproduced, modified, republished, distributed, displayed, sold, licensed, commercially exploited, or used in a way likely to cause confusion.

You may not use our intellectual property, or a confusingly similar version, for the uses listed below without authorization or another lawful basis:

• A business, product, or service.
• A domain name, website, social-media account, or username.
• An ad campaign, keyword, or metatag.
• Merchandise, packaging, a label, or promotional activity.

Automated Access and Artificial-Intelligence Use

Without prior written permission, you may not use bots, crawlers, scrapers, automated systems, or similar tools to access, copy, monitor, extract, download, collect, or reproduce Website content.

This restriction does not apply to ordinary public search-engine indexing that respects our technical directives.

Without prior written authorization, Website content may not be used to:

• Create datasets or train or improve artificial-intelligence or machine-learning systems.
• Generate derivative commercial content or imitate Firehouse Coffee's branding.
• Develop confusingly similar products, characters, packaging, names, or marketing materials.

Reviews, Photographs, and Customer Submissions

If you send a review, photo, comment, testimonial, suggestion, contest entry, or other content, you represent that you created it or have permission to submit it.

You also represent that it does not violate another person's intellectual-property, privacy, publicity, or other legal rights.

You grant Firehouse Coffee a nonexclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and share submitted content. This license covers use in connection with our business, Website, products, advertising, and promotions, subject to applicable law.

We may monitor, decline, edit, or remove content that is unlawful, fraudulent, misleading, threatening, defamatory, obscene, infringing, irrelevant, or otherwise inappropriate. We do not have to publish or keep any submission.

Prohibited Activities

We do not control unaffiliated third-party services. We are not responsible for their availability, content, security, accuracy, policies, or practices. Separate terms and privacy policies may govern your use of them.

Our Privacy Policy governs how we collect, use, and disclose personal information. By using the Website, you acknowledge that we handle information as described there and as permitted by applicable law.

Website Availability and Accuracy

To the fullest extent permitted by law, Firehouse Coffee's total liability for a claim concerning a particular order will not exceed the amount paid to Firehouse Coffee for the product or order giving rise to that claim.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Firehouse Coffee, LLC and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors from third-party claims, liabilities, damages, expenses, and reasonable attorneys' fees arising from your unlawful use of the Website, violation of these Terms, infringement of another party's rights, or fraudulent or unauthorized conduct.

Force Majeure

Firehouse Coffee will not be responsible for delay or failure caused by events beyond our reasonable control. Examples include:

• Engaged in unlawful or fraudulent activity.
• Threatened Website security.
• Harmed Firehouse Coffee or another party.

Provisions that by their nature should survive termination remain in effect. These include intellectual-property, payment, limitation-of-liability, indemnification, and dispute provisions.

Governing Law and Venue

These Terms and any dispute arising from the Website, Service, or a purchase from Firehouse Coffee will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

Except where applicable law requires otherwise, legal proceedings shall be brought in a court of competent jurisdiction located in Berks County, Pennsylvania, or in the United States District Court for the Eastern District of Pennsylvania.

The parties consent to the jurisdiction of those courts. Nothing in this section prevents either party from pursuing an eligible claim in small-claims court or exercising rights that cannot legally be waived.

Changes to These Terms

We may revise these Terms by posting an updated version here. The “Last updated” date shows the most recent revision.

Changes apply going forward when posted, unless another effective date is stated or applicable law requires more notice. Continued use of the Website after revised Terms take effect means you accept the revisions.

Severability, Waiver, and Entire Agreement

If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will remain effective.

Firehouse Coffee's failure to enforce a provision does not waive that provision or any other right.
