These Terms of Service govern your access to and use of FirehouseCoffee.com and any purchases made from Firehouse Coffee, LLC. Throughout these Terms, “Firehouse Coffee,” “we,” “us,” and “our” refer to Firehouse Coffee, LLC. “Website” and “Service” refer to this website and the products, features, content, and services made available through it.
By visiting this website, creating an account, submitting information, or placing an order, you agree to these Terms and to all policies referenced within them. If you do not agree, you may not use the Website or Service.
Our online store is hosted by Shopify, which provides the e-commerce platform used to offer our products and services.
ELIGIBILITY AND ACCEPTABLE USE
You must be at least the age of majority in your state of residence and legally capable of entering into a binding agreement to place an order or create an account.
You may not use the Website, Service, or our products for an unlawful, fraudulent, abusive, or unauthorized purpose. You must comply with all applicable federal, state, and local laws when using the Website.
CUSTOMER ACCOUNTS
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. Information provided to Firehouse Coffee must be accurate, complete, and current.
Notify us promptly if you believe your account or payment information has been accessed or used without authorization. We may suspend or terminate accounts that contain false information, appear fraudulent, violate these Terms, or threaten the security of the Website or our customers.
PRODUCT INFORMATION
We make reasonable efforts to describe and display our products accurately. Nevertheless, product photographs, colors, packaging, labels, artwork, ingredients, availability, roast appearance, and other details may occasionally differ from what is displayed.
Coffee is an agricultural product. Natural variations in beans, roast characteristics, aroma, flavor, grind, and appearance may occur between batches and do not necessarily constitute a defect.
Product descriptions and photographs may be corrected or updated without notice. We may modify, replace, limit, or discontinue any product at any time.
MEDICAL AND EMERGENCY-SERVICE TERMINOLOGY
Firehouse Coffee uses firefighter, emergency-service, medical, hospital, and related terminology as part of its branding and product storytelling. These names, descriptions, characters, and designs are not medical advice, medical claims, diagnoses, treatments, or promises of health benefits.
Unless expressly stated, the use of occupational, medical, or emergency-service terminology does not imply sponsorship, endorsement, certification, or affiliation with any hospital, fire department, police department, emergency-service agency, professional organization, or government entity.
Coffee and certain other products contain caffeine. Individual sensitivity to caffeine varies. Customers with medical conditions, allergies, dietary restrictions, or questions about caffeine consumption should consult an appropriate healthcare professional and contact Firehouse Coffee before purchasing if additional product information is needed.
ORDERS AND ORDER ACCEPTANCE
Placing an order constitutes an offer to purchase. Receipt of an order confirmation does not guarantee acceptance or fulfillment.
We reserve the right, to the extent permitted by law, to refuse, limit, hold, or cancel an order for reasons including:
• Product unavailability
• Pricing, description, inventory, or technical errors
• Suspected fraud or unauthorized payment activity
• Orders that appear intended for unauthorized resale
• Unusually large quantities
• Shipping restrictions
• Violations of these Terms or another Firehouse Coffee policy
If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.
Customers are responsible for reviewing product selections, grind choices, quantities, billing information, and shipping information before submitting an order.
PRICES, PAYMENTS, AND TAXES
Prices, promotions, discounts, and product availability are subject to change without notice. The price charged will generally be the price displayed at checkout when the order is submitted, subject to correction of obvious errors.
Applicable taxes and shipping charges are calculated or displayed at checkout. You represent that you are authorized to use the payment method submitted with your order.
We may correct pricing, promotional, inventory, or typographical errors and may cancel affected orders. Discounts cannot be combined unless expressly permitted. Promotional codes have no cash value and may be limited, modified, or discontinued as permitted by law.
SHIPPING AND DELIVERY
Orders are processed and shipped according to our Shipping Policy, which is incorporated into these Terms.
Customers are responsible for providing a complete and accurate delivery address. Shipping dates and carrier delivery estimates are estimates unless expressly identified as guaranteed.
Firehouse Coffee is not responsible for delays caused by USPS, severe weather, transportation disruptions, incorrect customer-provided information, natural disasters, government actions, or other circumstances beyond our reasonable control.
Claims involving delayed, missing, damaged, misdelivered, refused, unclaimed, or returned packages will be handled according to our Shipping Policy and Refund Policy, subject to applicable law.
RETURNS, REPLACEMENTS, AND REFUNDS
Returns, replacements, exchanges, and refunds are governed by our Refund Policy, which is incorporated into these Terms.
Because coffee, food, customized products, and certain other goods may be perishable, consumable, personalized, or unsuitable for resale, some products cannot be returned merely because of personal taste or preference.
Nothing in these Terms or our Refund Policy limits any non-waivable rights available under applicable law.
SUBSCRIPTIONS AND RECURRING ORDERS
When you purchase a subscription, you authorize recurring charges to the payment method associated with your subscription according to the price, frequency, and terms presented when you enroll.
Subscriptions continue until canceled or otherwise terminated. Customers are responsible for managing subscription selections, delivery schedules, payment information, and shipping addresses before the next order is processed.
Changes or cancellations submitted after a recurring order has entered processing may not apply to that order. Orders already prepared, fulfilled, or transferred to USPS cannot necessarily be canceled.
Subscription prices, discounts, products, and availability may change prospectively. Any required notice will be provided in accordance with applicable law and the subscription terms presented to the customer.
Additional subscription terms displayed during enrollment or within the customer’s subscription account are incorporated into these Terms.
GIFT CARDS AND PROMOTIONS
Gift cards, promotional credits, discount codes, giveaways, and special offers may be subject to additional conditions disclosed when issued.
Gift cards and promotional offers may not be reproduced, resold, transferred for value, or used fraudulently. We may reject or cancel gift cards, discounts, credits, or promotional transactions obtained or used through fraud, mistake, abuse, or unauthorized activity.
INTELLECTUAL PROPERTY
The Website and its content—including text, product descriptions, photographs, illustrations, artwork, graphics, logos, packaging, labels, characters, videos, website design, product names, slogans, and other original material—are owned by or licensed to Firehouse Coffee and are protected by intellectual-property laws.
FIREHOUSE COFFEE®, the Firehouse Coffee name and logo, and Firehouse Coffee’s product names, designs, characters, slogans, packaging, trade dress, and other brand identifiers are trademarks, registered trademarks, or other protected intellectual property.
Nothing on the Website grants a license or right to use Firehouse Coffee’s intellectual property. No protected content or brand identifier may be copied, reproduced, modified, republished, distributed, displayed, sold, licensed, commercially exploited, or used in a manner likely to cause confusion without prior written authorization.
You may not use Firehouse Coffee’s intellectual property—or any confusingly similar variation—in connection with a business, product, service, domain name, website, social-media account, username, advertising campaign, keyword, metatag, merchandise, packaging, label, or promotional activity without authorization or other lawful basis.

AUTOMATED ACCESS AND ARTIFICIAL-INTELLIGENCE USE
Except for ordinary public search-engine indexing that respects our technical directives, you may not use bots, crawlers, scrapers, automated systems, or similar technologies to access, copy, monitor, extract, download, collect, or reproduce Website content without prior written permission.
Website content may not be used to create datasets, train or improve artificial-intelligence or machine-learning systems, generate derivative commercial content, imitate Firehouse Coffee’s branding, or develop confusingly similar products, characters, packaging, names, or marketing materials without prior written authorization.
REVIEWS, PHOTOGRAPHS, AND CUSTOMER SUBMISSIONS
If you submit a review, photograph, comment, testimonial, suggestion, contest entry, or other content, you represent that you created it or have permission to submit it and that it does not violate another person’s intellectual-property, privacy, publicity, or other legal rights.
You grant Firehouse Coffee a nonexclusive, worldwide, royalty-free license to use, reproduce, display, publish, adapt, and share submitted content in connection with our business, Website, products, advertising, and promotional activities, subject to applicable law.
We may monitor, decline, edit, or remove submissions that are unlawful, fraudulent, misleading, threatening, defamatory, obscene, infringing, irrelevant, or otherwise inappropriate. We are not required to publish or retain any submission.
PROHIBITED ACTIVITIES
You may not:

We may restrict or terminate access and cancel related orders when prohibited activity is suspected.
THIRD-PARTY SERVICES AND LINKS
The Website may use or link to services operated by Shopify, payment processors, subscription providers, shipping carriers, review providers, social-media platforms, and other third parties.
We do not control and are not responsible for the availability, content, security, accuracy, policies, or practices of unaffiliated third-party services. Your use of those services may be governed by separate terms and privacy policies.
PRIVACY
Our collection, use, and disclosure of personal information are governed by our Privacy Policy. By using the Website, you acknowledge that information will be handled as described in that policy and as permitted by applicable law.
WEBSITE AVAILABILITY AND ACCURACY
We do not guarantee that the Website will always be uninterrupted, secure, current, or error-free. We may modify, suspend, restrict, or discontinue any part of the Website or Service when reasonably necessary.
The Website may occasionally contain typographical errors, incorrect prices, outdated availability information, or other inaccuracies. We may correct errors and update information as permitted by law, including after an order has been submitted.
DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Website and Service are provided on an “as is” and “as available” basis.
Except for warranties expressly provided by Firehouse Coffee or rights that cannot legally be excluded, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Website will meet every user’s expectations or that all errors will be corrected immediately.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Firehouse Coffee, LLC and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost revenue, lost data, business interruption, or replacement costs arising from or related to the Website, Service, or products.
To the fullest extent permitted by law, Firehouse Coffee’s total liability for a claim concerning a particular order will not exceed the amount paid to Firehouse Coffee for the product or order giving rise to that claim.
Some jurisdictions do not allow certain warranty exclusions or liability limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Firehouse Coffee, LLC and its owners, officers, employees, contractors, affiliates, suppliers, service providers, and licensors from third-party claims, liabilities, damages, expenses, and reasonable attorneys’ fees arising from your unlawful use of the Website, violation of these Terms, infringement of another party’s rights, or fraudulent or unauthorized conduct.
FORCE MAJEURE
Firehouse Coffee will not be responsible for delay or failure caused by events beyond our reasonable control, including severe weather, fire, flood, natural disaster, epidemic, labor disruption, carrier interruption, equipment failure, utility or internet outage, supply shortage, government action, civil disturbance, or similar events.
TERMINATION
These Terms remain effective while you use the Website or Service. We may suspend or terminate access when we reasonably believe a user has violated these Terms, engaged in unlawful or fraudulent activity, threatened Website security, or harmed Firehouse Coffee or another party.
Provisions that by their nature should survive termination—including intellectual-property, payment, limitation-of-liability, indemnification, and dispute provisions—will remain effective.
GOVERNING LAW AND VENUE
These Terms and any dispute arising from the Website, Service, or a purchase from Firehouse Coffee will be governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.
Except where applicable law requires otherwise, legal proceedings shall be brought in a court of competent jurisdiction located in Berks County, Pennsylvania, or in the United States District Court for the Eastern District of Pennsylvania. The parties consent to the jurisdiction of those courts.
Nothing in this section prevents either party from pursuing an eligible claim in small-claims court or exercising rights that cannot legally be waived.
CHANGES TO THESE TERMS
We may revise these Terms by posting an updated version on this page. The “Last updated” date identifies the most recent revision.
Changes apply prospectively when posted unless another effective date is stated or applicable law requires additional notice. Continued use of the Website after revised Terms become effective constitutes acceptance of those revisions.
SEVERABILITY, WAIVER, AND ENTIRE AGREEMENT
If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the greatest extent permitted, and the remaining provisions will remain effective.
Firehouse Coffee’s failure to enforce a provision does not waive that provision or any other right.
These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, Copyright and Intellectual Property Notice, and any additional terms presented at checkout, constitute the agreement governing your use of the Website and purchases from Firehouse Coffee.
